Official Promotional Rules

A complete copy of these rules can be obtained at the offices of radio station KCFX-FM, KCJK-FM, KMJK-FM, KCMO-FM, (the “Stations”) owned and operated by Cumulus Media Partners LLC, 5800 Foxridge Drive, Mission Kansas 66202, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

1. No purchase is necessary
   
   
2. Contest is open only to legal U.S. residents who are of legal age 21 at the time of entry. 
   
3. All contests are open to the general public except for employees, agents, representatives, or affiliates of the Stations Cumulus Broadcasting LLC, and their respective affiliates, participating sponsors, their immediate families, and household members.
   
   
4. An individual may win an on-going contest only once per six-month period unless otherwise specifically stated.   An individual may win other seasonal or one-time contests only once for the duration of the contest.
   
   
5. The contest will begin on May 15, 2008 and will run through August 9, 2008.
   
6. Two grand prizes will be awarded.  There are two separate grand prize Harley Davidson Motorcycles to be given away in this contest. There will be one grand prize winner of a motorcycle in the state of Missouri, and one grand prize winner of a motorcycle in the state of Kansas. The Harley Davidson Motorcycles that may be won are:
   1.1200N Sportster Nightster Motorcycle supplied by Gail’s Harley-Davidson/Gail’s Power Sports.  
   Grand prize package #1 includes (1) 1200N Sportster Nightster Motorcycle Night Rod® motorcycle (ARV $10,735.00). Prize consists only of the item specifically listed as part of the prize and does not include additional options, license, insurance, title, registration fees and taxes. Winner must take delivery of prize at Gail’s Harley Davidson in Grandview Missouri.
              
   2.Harley V-Rod Motorcycle supplied by Miller Brewing Company.
   Prize includes (1) 2008 Harley-Davidson® VRSCD Night Rod® motorcycle (ARV $15,000.00). Prize consists only of the item specifically listed as part of the prize and does not include additional options, license, insurance, title, registration fees and taxes. Winner must take delivery of prize at a Harley-Davidson® dealership as designated by Sponsor.

7. By accepting prize, winner agrees to hold The Stations (KCFX-FM, KCJK-FM, KCMO-FM, & KMJK-FM), Cumulus Media Partners LLC, Gail’s Harley Davidson/Gail’s Power Sports, Miller Brewing Company, SABMiller plc, Harley-Davidson Motor Company, Inc., Collaborative Marketing Group, Inc., their distributors and alcoholic beverage retailers, affiliates, subsidiaries, advertising and promotion agencies, as well as their respective affiliates, officers, directors, agents, employees and assigns, harmless against any and all claims arising out of use or misuse of prize and acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any  warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability, except in regard to Sponsor and the standard written warranty statement provided with the motorcycle. Harley-Davidson Motor Company, Inc. is merely a prize provider and has no responsibility in the conduct or administration of this promotion.
   
   
8. Entrants may register by attending one of the “Better Bolder Summer” Miller Lite events, or a Gail’s Harley Davison event during the contesting event time frame, and filling out a registration form on-site, or by qualifying by participating in on-site contesting to determine an immediate on-site qualifier. Contestants will have the opportunity to compete in a time Trial competition by playing the Play Station 2 Game “Harley-Davidson: Ride to the Rally”. The top 2 time trials of the night will win a “Miller Prize Pack”, and be automaticly invited to both Pay off events for the chance to win one of the two Harley Davidson Motorcycles. In the event that the Video game is not able to be set up due to technical issues, or room limitations contestants will simply fill out a registration form, and 4 qualifiers will be drawn at the end of each event. There will be up to 4 on-site qualifiers for each “Better Bolder Summer” Miller Lite On-Premise (Bar Location), and Off Premise (Retail Store Location) event, or a Gail’s Harley Davison event. Entrants may also qualify three (3) times a day by listening to 94.9 KCMO-FM from 5/19/08-6/14/08, 107.3 Magic KMJK-FM from 6/2/08-6/28/08, 105.1 JACK KCJK-FM & 101.1 The Fox KCFX-FM from 6/30/08-7/25/08 Listeners may also register by delivering a letter to the Stations at 5800 Foxridge Drive 6th floor, Mission, Kansas 66202 Attn: Miller Lite Bike Contest, during normal business hours, which shall contain his/her name, age, phone number(s).  All entries must be received by July 25th, 2008 and the contest will be limited to the first 1,000 qualifiers.
   
   
9. The Stations and Cumulus Media Partners LLC are not responsible for any incorrect or inaccurate information entered by website users or communicated by telephone, written, or other means of communications , and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction unauthorized access to the Stations' websites, or technical problems relating to the means of communication, whether by telephone, written, or otherwise.
   
   
10. On or around July 26th 2008 (dates subject to change) all contest qualifiers (up to 1,000 total) will have the opportunity to participate in two (2) Key Drawing Pay Off events. Qualifiers must be present to win. At each Pay Off event, one qualifier will receive a winning key, such key being the key able to start the Motorcycle to be given away at that event.  The holder of the winning key will be the grand prize winner of one of the two Harley Davidson Motorcycles. On or around August 2nd or 9th 2008 (dates subject to change) all remaining qualifiers will have the opportunity to participate in a Key Drawing at the Pay Off event. Again, qualifiers must be present to win. One qualifier at that event will receive a winning key, and he/she will be the second grand prize winner of one of the two Harley Davidson The Grand Prize Winners must have the ability to pay taxes on the Motorcycle, must be 21 years of age, must have the ability to participate and attend the final Pay off event on one of the dates listed above (pay off event dates for both giveaways subject to change), and in order to drive the motorcycle must have a legal Motorcycle license. If the Grand Prize winner does not have a valid Motorcycle driver’s license, he/she will not be permitted to drive the motorcycle until such time as the license is obtained.  If it is determined that the candidate is not eligible for receipt of the grand prize, in Cumulus’/Stations'/Sponsors'sole judgment and discretion, another candidate will be selected by Cumulus/the Stations/the Sponsors a random drawing from the list of Qualifiers names, and this process will continue on until such time as an eligible winner is found.  In the unlikely event that no candidates are found to meet the specifications, then the prize(s) will go un-awarded.  In the event of a tie, the winner will be determined by and at the sole discretion of Cumulus/the Stations/the Sponsors. All decisions regarding this contest made by Cumulus/Stations management/the sponsors are final, including, without limitation, the selection of the winners.
    
    
11. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued $600 or more will be issued an IRS Form 1099 to report their winnings.
    
    
12. All prizes are awarded “as is.”   Prizes are nontransferable and cannot be exchanged.
    
    
13. Neither the Stations nor Cumulus Media Partners LLC, its, subsidiaries, affiliates, members, directors, officers, employees, agents or representatives shall be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
    
    
14. All entrants and winners agree that the Stations, Cumulus Media Partners LLC, and its subsidiaries, affiliates, members, directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.
    
    
15. All prizes must be claimed in person at the Stations studio at the address identified above during regular business hours and within ten (10) business days of winning, excluding holidays.  After such time, ownership of said prize reverts back to Cumulus Media Partners LLC to be disposed of at its discretion.  The winner then loses all claims and rights to said prize.
    
    
16. Proper identification must be presented by any winner to claim prize.  As a condition to receiving the prize, any potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Stations, Cumulus Media Partners LLC, its subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize.
    
    
17. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Stations and Cumulus Media Partners LLC to be used, disposed of or destroyed in their sole discretion.
    
    
18. All entrants and winners agree to give the Stations and Cumulus Media Partners LLC, its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publishhis/her name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Stations Deem necessary without compensation,  unless prohibited by law.  All winners release, discharge, and agree to save harmless Cumulus Media Partners LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against the Stations or Cumulus Media Partners LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that Cumulus Media Partners LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Media Partners LLC.
    The Stations reserve the right to end the contest at any time or modify the rules of the contest without any advanced notice to the public.  Odds of winning are based on the number entries received.   
    
    
19. The Stations reserve the right to limit the number of times an individual may enter a contest or drawing.
    
    
20. The Stations reserve the right to require contestants to be present at drawings in order to win their prize.
    
    
21. Violations of any of these rules or attempts to win any contest by fraud, deception, or cheating shall be grounds for the Stations to disqualify any individual from participating in all current and future contests and events at the sole discretion of the Stations, as well as forfeiture of any prize or prizes won by fraudulent means.
